  1. Personal Information

Your privacy is very important to all of us at My Shelf, LLC, an Arizona limited liability company (“Company”, “we”, “our”, or “us”). Company has established this privacy statement (“Privacy Statement”) to explain to you how your personal information is protected, collected, and used when you use the Company website and associated mobile application (collectively the “Site”) or Company’s Services (as defined in the Terms of Service) accessible through the Site. Personal information is information about you that is personally identifiable, such as your name, email address, and other information, that is not otherwise publicly available (“Personal Information”). 

This statement applies to information Company collects:

  • On the Site.
  • In email and other electronic messages between you and the Site.
  • Through mobile and desktop applications you download from the Site, which provide dedicated non-browser-based interaction between you and the Site.

Please read this Privacy Statement carefully to understand Company’s policies and practices regarding your information and how it is treated. If you do not agree with Company’s policies and practices, your choice is not to use the Site and/or Services. By accessing or using the Site and/or Services, you agree to be bound by the terms and conditions of this Privacy Statement. 

This Privacy Statement may change from time to time. Your continued use of this Site and/or Services after Company makes changes is deemed to be acceptance of those changes, so please check the Privacy Statement periodically for updates. This Privacy Statement is incorporated into and subject to Company’s Terms of Service.

  1. Information Collection & Use

To access the Site and Services, you are required to create a user account, including user ID (your email address) and password, and input certain Personal Information, including your email address. Company collects Personal Information from you through the Site and Services to provide services that will most likely meet your needs and preferences. Company only collects Personal Information about you that Company considers necessary for achieving this purpose.

In general, you can browse the Site and “opt-out” from providing any Personal Information. Once you agree to provide Personal Information, you are no longer anonymous to Company. If you choose to use and/or purchase certain Services, Company may require you to provide contact and identity information, billing information, and other Personal Information as indicated on the forms throughout the Site. Where possible, Company indicates which fields are required and which are optional. You always have the option to not provide information by choosing not to use or purchase a particular service.

The information Company collects about users of the Site may include:

  • Information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, IP address, or any other identifier by which you may be contacted online or offline.
  • Information based on your behavior on the Site such as information that is about you but does not identify you, such as the URL that you came from, which URL you go to next, your computer browser information, the equipment you use to access our Site, activity patterns, key strokes, search queries, browsing history, and additional usage details.
  • Information that you provide by filling in forms on the Site. This includes information provided at the time of registering to use the Site, subscribing to the Services, posting material, requesting further Services, or reporting a problem with the Site and/or Services.
  • Records and copies of your correspondence, if you contact Company or if other users or third parties send Company correspondence about your activities or postings on the Site.
  • Details of transactions you carry out through the Site and of the fulfillment of your orders.

Company collects this information directly from you when you provide it to Company and automatically as you navigate the Site. 

You may always cancel your subscription by following instructions from the applicable in-app store. Upon cancellation of your subscription, Company will cease authorizing further monthly or annual recurring charges, as applicable. 

  1. Use of Your Personal Information

Company uses your Personal Information, and other information obtained from your current and past activities on the Site to: present the Site and its contents to you; resolve disputes; troubleshoot problems; measure consumer interest in our services; inform you about online and offline offers, products, services, and updates; customize your experience on the Site; detect and protect Company against error, fraud, and other criminal activity; to provide you with notices about your account/subscription; carry out Company’s obligations and enforce Company’s rights arising from any contracts entered into between you and Company, including for billing and collection; enforce the Terms of Service; and as otherwise described to you at the time of collection. Company may compare and review your Personal Information for errors, omissions, and accuracy.

You agree that Company may use your Personal Information, including your email address, to improve Company’s marketing and promotional efforts, to analyze Site usage, to improve Services, and to customize the Site’s content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe, and customized experience while using the Site and Services.

Legal Basis for processing your information. If you are a user or customer located in the European Economic Area (“EEA”) or Switzerland, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. We will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate business interests. In some cases, we may also have a legal obligation to collect personal information from you.   1. Company Communications 

Company may occasionally send you information on products, services, special deals, and promotions. Out of respect for your privacy, Company provides you a way to unsubscribe from each of these communications. If you no longer wish to receive promotional communications, you may opt-out of receiving them by following the instructions included in each such communication or by contacting Company.

Company will send you strictly service-related announcements on rare occasions when necessary to do so. For instance, if access to the Site or Services is temporarily suspended for maintenance, Company may send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, please do not submit your Personal Information through the Site.

  1. Information Sharing and Disclosure

As a matter of policy, Company does not sell, rent, or share any of your Personal Information, including your email address, to third parties for their marketing purposes without your explicit consent. However, the following describes some of the ways that your Personal Information may be disclosed in Company’s normal scope of business:

  • Purpose: Company may disclose your Personal Information to fulfill the purpose for which you provide it. 
  • Buyers or Successors: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company about Site users is among the assets transferred.
  • Legal Requests: Company cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you, other users, and Company from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, Company can (and you authorize Company to) disclose your name, city, state, telephone number, email address, username history, and fraud complaints without a subpoena. Without limiting the above, in an effort to respect your privacy, Company will not otherwise disclose your Personal Information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when Company believes in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss, or report suspected illegal activity.

  • Other Disclosures: Company may also disclose your Personal Information: (i) to enforce or apply any agreement you have with Company, including for billing and collection purpose; or (ii) if Company believes disclosure is necessary or appropriate to protect the rights, property, or safety of Company, its customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Company may disclose aggregated information about users, and information that does not identify any individual, without restriction.

  1. Cookies and Related Technologies

When you use the Site and Services, Company collects certain information by automated electronic means, which may include: 

  • Browser Cookies – A cookie is a small file placed on the hard drive of your computer or mobile device. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Site and/or Services. Unless you have adjusted your browser setting so that it will refuse cookies, Company’s system will issue cookies when you direct your browser to the Site.
  • Flash Cookies – Certain features of the Site may use locally stored objects called Flash Cookies to collect and store information about your preferences and navigation to, from, and on the Site. Flash Cookies are not managed by the same browser settings as are used for Browser Cookies.
  • Web Beacons – Company emails and certain pages of the Site may contain small electronic files known as Web Beacons that permit Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). Web Beacons are sometimes also referred to as clear gifs, pixel tags, and single-pixel gifs.
  • Session Cookies are temporary cookies used for various reasons, such as managing page views, and are usually erased by your browser when you exit it. 
  • Persistent Cookies are used for a number of reasons, such as storing your preferences and retrieving certain information you have previously provided. Persistent Cookies are stored on your devices after you exit your browser.

The term “Cookies” is used to include Browser Cookies, Flash Cookies, Web Beacons, Session Cookies, and Persistent Cookies.

The information from Cookies is also stored in web server logs, which are then transmitted back to the Site by your computers or mobile devices. These servers and Cookies are operated and managed by Company and/or its service providers. As you use the Site and Services, your browsers communicate with servers operated by Company and/or its service providers to coordinate and record the interactivity and fill your requests for services and information.

Cookies are also used to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the Site, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Site; and
  • Information about your computer and internet connection, including your IP address, operating system, and browser type. 

The information Company collects is statistical and may include Personal Information, which Company may maintain or associate with Personal Information Company collects in other ways or receives from third parties. Cookies help Company improve and deliver better Site and Services, including by enabling Company to: estimate audience size and usage patterns; store information about your preferences; speed up searches; and recognize you when you return to the Site.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications on the Site and/or Services are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Site. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Company may use third parties such as network advertisers to serve advertisements on the Site and on third-party websites or other media (e.g., social networking platforms) that enable Company and third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors, and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy statement, not this one. Company may provide these third-party advertisers with information, including personal information, about you.

Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and your choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative’s (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and your choices regarding having information used by NAI members. The NAI’s main webpage is located at www.networkadvertising.org. Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through the Site or on other websites or applications. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Additional information is available on the DAA’s website or the NAI’s website. 

Company does not control third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

  1. Manage Your Security Settings

You may manage how your browser handles cookies and related technologies by adjusting its privacy and security settings. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available. You can opt-out of being targeted by certain third-party advertising companies online at http://www.networkadvertising.org/choices/.

You may manage how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.

If you wish to opt out of receiving offers directly from Company, you can follow the opt-out instructions included in the emails.  

Some internet browsers have incorporated “Do Not Track” features. Company does not currently respond to Do Not Track features.

  1. Choices About How Company Uses and Discloses Your Information

Company strives to provide you with choices regarding your Personal Information. Company has created the following mechanisms to provide you with control over the Personal Information you provide to Company:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Site and Services may then be inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want Company to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by using the opt-out method. You can also always opt-out by sending an email stating your request to [email protected].
  • Promotional Offers from Company. If you do not wish to have your email address/contact information used to promote Company or third parties’ products or services, you can opt-out by sending an email stating your request to [email protected]. This opt out does not apply to information provided as a result of a product purchase, warranty registration, product service experience, or other transactions.
  • Targeted Advertising. If you do not want Company to use information that it collects or that you provide to deliver advertisements according to Company’s advertisers’ target-audience preferences, you can opt-out by sending a request to [email protected]. For this opt-out to function, you must have your browser set to accept browser cookies. 
  1. California Privacy Rights

California residents may have additional rights regarding Personal Information. If you are a California resident, you may have the following right regarding your personal information: 

Right to Access: You can access your collected personal information by contacting Company at [email protected]. 

  • Right to Correct, Update, or Delete: You can request that Company corrects, updates, or deletes your Personal Information by contacting Company at [email protected]. In some situations, Company can’t make changes to or delete your information if, for example, Company needs your information to complete transactions, continue providing services to you, or comply with applicable law.  

  • Right to Request Disclosure of Information Collected: Please contact Company at [email protected] to request further information about the categories of Personal Information collected about you, where Company collects your Personal Information, and for what purpose Company uses your Personal Information.

  • Right to Disclosure of Information Sold and Right to Opt-Out: You have the right to know what information of yours Company has sold, and you have the right to opt-out of any sale of your information. If you have any questions about these rights, please contact Company at [email protected].

  • Right to Non-Discrimination: Company does not and will not discriminate against you if you exercise your rights under the California Consumer Privacy Act of 2018 (“CCPA”).

When you contact Company regarding any of your rights under the CCPA, Company will verify your identity before providing any information.   1. Security

Company follows generally accepted industry standards to protect Personal Information during transmission and once received by Company. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. By way of example (without limiting the foregoing), Company may be forced to disclose Personal Information, including your email address, to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your Personal Information that they collect from Company. Therefore, although Company uses industry standard practices to protect your privacy, Company does not promise, and you should neither rely upon nor expect, that your Personal Information or private communications will always remain private and Company cannot guarantee the absolute security of your Personal Information. Any transmission of Personal Information is at your own risk. Company is not responsible for circumvention of any privacy settings or security measures contained on the Site or via the Services.

The safety and security of your information also depends on you. Where you have a password for access to certain parts of the Site, you are responsible for keeping this password confidential and to not share your password with anyone. 

  1. Changes in this Privacy Statement

If Company decides to change the Privacy Statement, Company will post those changes to this Privacy Statement and other places Company deems appropriate so that you are aware of what information Company collects, how that information is used, and under what circumstances, if any, Company discloses it. Company reserves the right to modify this Privacy Statement at any time, so please review it frequently.

  1. Children Under the Age of 13  

The Site and Services are intended for and directed towards adults and Company does not knowingly collect Personal Information from children under the age of 13. The Site is not intended for children under 13 years of age. No one under age 13 may provide any Personal Information on or to the Site. 

If you are under the age of 13, do not use or provide any information on this Site or through the Services, make any purchases through the Site, use any of the interactive or comment features of the Site, or provide any information about yourself to Company, including your name, address, telephone number, or email address. If Company learns that it has collected or received personal information from a child under the age of 13 without verification of parental consent, Company will delete that information. If you believe Company might have any information from or about a child under the age of 13, please contact Company at [email protected].

  1. Additional Considerations for Users Located Outside of the United States

By viewing or browsing the Site, you acknowledge and agree that: (i) Company will process your information as described in the Privacy Statement; and (ii) you consent to transferring your information (including personal information) to Company and its facilities in the United States or elsewhere, including those of third parties as described in the Privacy Statement. 

If you are based in the EEA or Switzerland you may have other rights regarding your Personal Information:

  • Right of Access: You can access your collected Personal Information by contacting Company at [email protected]. 

  • Right to Correct, Update, or Delete: You can correct, update, or request deletion of your Personal Information by contacting Company at [email protected].

  • Right to Restrict Processing: You can ask Company to restrict processing your Personal Information.

  • Right to Take Your Data: You can ask to take your Personal Information that you provided to Company, in a structured format, from Company.

  • Right to Object: You may object on to the processing of your Personal Information by Company at any time. This right does not exist if Company has already processed your personal information.

  • Data Protection Authority: You have a right to raise questions or complaints with your local data protection authority at any time.
